By accessing or using OnCue Gifts at oncuegifts.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
OnCue Gifts is a subscription-based gifting concierge service. We curate, select, and deliver gifts to recipients you designate on occasions you specify. Our service includes gift selection, personalized card writing, ordering, and delivery coordination.
OnCue Gifts offers annual and monthly subscription plans. By subscribing, you agree to the following:
Approximately 14 days before each scheduled occasion, we will send you a preview of the selected gift via email. The gift will be automatically ordered unless you request a change by replying to the preview email. If you request a substitution, we will make reasonable efforts to fulfill your request based on availability and budget constraints.
Once a gift has been ordered it cannot be cancelled, modified, or refunded. It is your responsibility to review gift previews upon receipt. By subscribing to OnCue Gifts you acknowledge and agree to this automatic ordering process.
You may cancel your subscription at any time through your subscriber portal. Cancellation takes effect at the end of your current billing period. Subscription fees are non-refundable except where required by applicable law.
OnCue Gifts coordinates gift selection and ordering on your behalf through third-party merchants, suppliers, and fulfillment partners. Once a gift has been approved and ordered, delivery timing is entirely dependent upon those third-party merchants, suppliers, and shipping carriers including but not limited to FedEx, UPS, USPS, and other carriers. OnCue Gifts is not responsible for delays, losses, or damages caused by those parties.
We make every reasonable effort to order gifts with sufficient lead time to arrive before your specified occasion. However, we cannot guarantee specific delivery dates due to carrier availability, supply chain disruptions, weather events, natural disasters, product availability, merchant processing times, customs delays for international shipments, or other circumstances outside our control.
While OnCue Gifts makes commercially reasonable efforts to coordinate timely gift delivery, OnCue Gifts does not guarantee delivery by any specific date, including birthdays, anniversaries, holidays, or other occasions.
You are solely responsible for ensuring all recipient shipping addresses are accurate and complete. OnCue Gifts is not responsible for gifts that are undeliverable, lost, or delayed due to incorrect or incomplete address information provided by you.
In the event of a delivery failure caused by a third-party carrier or merchant, we will make reasonable efforts to assist in resolution but cannot guarantee replacement gifts or refunds from third-party providers.
You represent and warrant that you have the right to provide recipient information to us and that recipients consent to receiving gifts sent through our service. You are responsible for ensuring all addresses and recipient details are accurate.
You agree not to use OnCue Gifts to send gifts that are illegal, harmful, threatening, harassing, or otherwise objectionable. We reserve the right to refuse service to anyone for any reason at any time.
OnCue Gifts is a gift coordination and concierge service. While we make reasonable efforts to ensure gifts are selected, approved, ordered, and delivered as scheduled, we expressly cannot guarantee delivery dates, product availability, shipping carrier performance, recipient availability, weather events, supply chain disruptions, third-party merchant fulfillment, or other circumstances outside our direct control.
To the maximum extent permitted by applicable law, OnCue Gifts shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or any other financial or personal losses, even if OnCue Gifts has been advised of the possibility of such damages.
Our total cumulative liability to you for any and all claims arising out of or relating to your use of the service shall not exceed the total amount paid by you to OnCue Gifts in the twelve months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
OnCue Gifts is intended solely to assist subscribers with gift selection, occasion management, and gift delivery coordination. We make no representations, warranties, or guarantees of any kind regarding personal, emotional, professional, family, romantic, or business outcomes resulting from the use of our services.
OnCue Gifts expressly disclaims any liability for outcomes including but not limited to: recipient dissatisfaction with a selected gift, personal or romantic relationship issues, family disputes, professional or business relationship outcomes, employee morale, client relationship results, or any other interpersonal outcome whether positive or negative.
Gift selection is based on information provided by the subscriber. The quality and appropriateness of any gift recommendation is inherently subjective. OnCue Gifts does not guarantee that any gift will be received positively by any recipient. Subscriber assumes all risk related to recipient response to gifts coordinated through our service.
OnCue Gifts shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to acts of God, weather events, natural disasters, labor disputes, supply chain disruptions, shipping carrier failures, internet outages, governmental actions, pandemic or public health emergencies, civil unrest, or other unforeseen events outside our reasonable control. In such circumstances, our obligations under these Terms will be suspended for the duration of the event.
We reserve the right to modify these terms at any time. We will provide notice of significant changes via email. Continued use of the service after changes constitutes acceptance of the new terms.
